1. Eligibility & Use of the Site

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order. You agree to use the Site lawfully and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Fraudulent, disruptive, or unauthorised use — including hacking, scraping, spamming, reverse-engineering, or misrepresentation — may result in suspension or termination of access and legal action.

2. Products & Fitment

Shift Mantra sells genuine motorcycle and bicycle parts and accessories sourced from our brand partners and authorised channels. Product descriptions, specifications, images, and fitment data (including any “Select Make / Model / Year” guidance) are provided for reference only and may vary slightly due to manufacturer updates, production batches, or display settings on your device. While we make reasonable efforts to ensure fitment information is accurate, it remains your responsibility to confirm that a Product is compatible with your specific vehicle before purchase and installation. We may revise specifications, packaging, or discontinue any Product without prior notice, in compliance with applicable laws.

3. Orders & Acceptance

Submitting an order on the Site constitutes an offer to purchase the selected Products. All orders are subject to our acceptance, confirmation, and availability of stock. A contract of sale is formed only when we dispatch the Products or send an express confirmation of acceptance, not merely upon payment or order acknowledgement. We reserve the right to limit quantities, correct pricing or description errors, and cancel or refuse any order — including after acceptance — where we suspect fraud, unauthorised or unlawful activity, pricing errors, or stock unavailability. Where an order is cancelled by us after payment, the amount paid will be refunded.

4. Pricing & Payment

All prices are listed in Indian Rupees (INR / ₹) and are inclusive of applicable Goods & Services Tax (GST) unless stated otherwise. Shipping, handling, or other charges, where applicable, will be shown at checkout before you confirm your order. Payments may be made through the payment methods offered on the Site, including UPI, debit/credit cards, net banking, and supported wallets, via our third-party payment gateway partners. By submitting payment details, you confirm that you are authorised to use the chosen payment method. We do not store your full card or bank details; these are processed securely by our payment partners.

5. Shipping & Delivery

We deliver across India through our logistics and courier partners. Estimated delivery timelines are indicative and may be displayed after you enter your delivery pincode. Delays may occur due to courier issues, stock location, force majeure events, or regulatory checks. Title and risk of loss in the Products pass to you once the Products are handed over to the courier for delivery to your address. Please inspect the packaging at the time of delivery and report any visible damage or tampering promptly (see Section 6).

6. Returns, Replacements & Refunds

We want you to be satisfied with your purchase. Subject to verification, we accept returns or replacements in the following circumstances:

• The Product delivered is incorrect or does not match your order;
• The Product was damaged in transit; or
• The Product is defective or has a tampered or broken safety seal on arrival.

Our support team will guide you through the process.

Important: For hygiene, safety, and warranty reasons we cannot accept returns of Products that have been installed, used, fitted, or whose seals or packaging have been opened, except where the Product is defective or covered by a manufacturer warranty. Certain items — including consumables (such as lubricants, cleaners, and chain wax), electrical and electronic components, and special-order or made-to-fit items — may be non-returnable unless faulty. Approved refunds are processed to the original payment method within the timeframe required by applicable law and our payment partners’ processing times.

7. Manufacturer Warranties

Many Products are covered by warranties offered by their respective manufacturers or brand owners (for example, limited or lifetime warranties on certain lighting or performance components). Such warranties are provided by the manufacturer, on the manufacturer’s terms, and not by Shift Mantra. We will reasonably assist you in raising a warranty claim with the relevant manufacturer. Except for warranties expressly provided by us or required under applicable law, Products are supplied on the basis set out in Section 9.

8. Intellectual Property

All rights in the Site — including its design, text, graphics, images, logos, layout, and software — and the “Shift Mantra” name and brand are the property of Stark Motorsports or its licensors and are protected under applicable intellectual property laws. Third-party brand names, trademarks, and product images displayed on the Site (such as those of our brand partners) remain the property of their respective owners and are used for identification and descriptive purposes only. No content from the Site may be copied, reproduced, republished, or commercially exploited without our prior written consent or that of the relevant rights holder.

9. Disclaimers & Safe Use

Products are intended to be selected, installed, and used in accordance with the manufacturer’s instructions, applicable laws, and good engineering practice. Improper selection, installation, modification, or use of motorcycle or bicycle components can affect vehicle safety and roadworthiness; where you are not confident, we strongly recommend professional installation. To the extent permitted by law, the Site and Products are provided “as is” and “as available” without warranties of any kind, express or implied, other than those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, error-free, or secure. We disclaim liability for misuse, improper installation or storage, non-compliance with manufacturer instructions, or use of Products in a manner not permitted by law.

10. Limitation of Liability

To the fullest extent permitted under Indian law, ShiftMantra (A Stark Motorsports venture) shall not be liable for any indirect, incidental, special, or consequential damages — including loss of profits, data, goodwill, or vehicle downtime — arising out of or in connection with your use of the Site or the Products. Our aggregate liability for any claim relating to a Product shall not exceed the purchase price paid by you for that Product. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. User Content

If you post reviews, ratings, testimonials, photographs, or other feedback on the Site, you grant ShiftMantra (A Stark Motorsports venture) a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content for marketing and informational purposes. You confirm that you own or have the right to share such content and that it is accurate. You agree not to submit content that is unlawful, infringing, offensive, misleading, or that violates any third party’s rights. We may edit or remove user content at our discretion and without notice.

12. Third-Party Links & Services

The Site may contain links to third-party websites or services, and relies on third-party providers for payments, shipping, and analytics. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is governed by their respective terms and privacy policies.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable rules. By using the Site, you consent to the practices described in the Privacy Policy.

14. Governing Law & Dispute Resolution
